The man who was charged with hit-and-run and injured a 4-year-old child appeared before a judge Monday afternoon.

David Nelson Duphigny, 58, has been charged with causing serious injury in a hit-and-run.

Jace Rainey’s family says he was airlifted to hospital after being hit while riding a scooter Saunders Street Sunday.

Honea Pass Police Chief Barry New said Rainey was playing with other children in his grandmother’s front yard.

Duphigny was immediately taken into custody, New said.

A dozen family members and friends gathered in court to stand by Jace.

The child’s grandfather told WYFF News 4 that the child was seriously injured and has a long road to recovery.

He told the judge what he saw on Sunday.

“He hit him in the road like he killed him in the road. This monster on screen, my grandson can’t get out of the hospital. How can he get out of that cell?” Douglas Laney said.

“Justice was not served. It’s not fair that a four-year-old baby is playing in the street and he hits him and runs away,” said Valentina Lee, Jace’s aunt.
